Terms of Service

These terms are the agreement between you and PECH ENERGY SOLUTIONS LTD (RC 8424221) for your use of Lumina Catalog at catalog.luminaleads365.com. By creating an account you accept them.

1. What the service does

Lumina Catalog lets a business build a product catalog, publish it as a single web link, share that link on WhatsApp and other channels, and receive price enquiries and quote requests from the people who open it. It also offers optional AI assistance for writing product details, and optional paid plans with higher limits.

We provide the software. We do not sell, stock, ship, inspect or guarantee any product listed by a seller using it.

2. Your account

• You must be at least 18, or the age of majority where you live, whichever is greater.
• You are responsible for everything done through your account, and for keeping your password private.
• One account represents one business. Tell us promptly if you believe your account has been accessed by someone else.
• You must give accurate account details and keep them current.

3. Acceptable use

You may not use Lumina Catalog to:

• list goods you may not lawfully sell in your country, including counterfeit goods, stolen goods, prescription medicines you are not licensed to supply, weapons, or controlled substances;
• upload another business's photographs, logos, trademarks or catalog pages without their permission;
• misrepresent a product's specification, origin, condition or price;
• send bulk unsolicited messages, or collect enquiry details in order to market something unrelated;
• attempt to access another seller's catalog data, probe our systems, or work around access controls, rate limits or plan limits.

We may suspend or close an account that breaches this section. Where the breach is not serious and can be fixed, we will normally tell you what is wrong and give you a chance to fix it first.

4. Your content stays yours

Your catalogs, product photographs, descriptions, prices and business details remain yours. You grant us only the permission we need to run the service — to store your content, to display it to people who open your catalog link, and to generate previews of it (such as the image that appears when your link is shared). That permission ends when you delete the content, except for backups still in their retention window.

You confirm that you have the right to publish everything you upload, and you accept responsibility for it.

5. Enquiries and buyer information

When someone requests a quote from your catalog, they give a name and contact details. That information is collected for you, not for us. In data protection terms you are the controller of it and we act as your processor: we store it, show it to you, and do nothing else with it.

This means the legal duties toward that person are yours. You must use their details only to answer their enquiry and to carry out any resulting sale, keep them no longer than you need them, and respond if they ask you to delete them. Our Privacy Policy explains how we handle the data on our side.

6. Quotes, invoices and payment between you and your buyer

A quote or invoice produced in Lumina Catalog is an agreement between you and your buyer. We are not a party to it. We do not process, hold, escrow or guarantee money paid by a buyer to a seller, and we are not responsible for delivery, quality, returns or any dispute arising from that sale.

Totals are calculated on our servers from the prices you enter. Currency conversion, taxes, duties, delivery charges and payment terms are for you to set and to state.

7. Paid plans

Plan prices are shown in Nigerian Naira on the pricing screen before you pay, and are charged for the term you choose. Payments are taken by Paystack or Flutterwave; we never see or store your full card details.

Plans renew for the same term unless cancelled before the renewal date. Cancelling stops the next renewal — it does not shorten the term you have already paid for. Refunds are covered separately in our Refunds & Cancellation policy, which forms part of these terms.

We may change plan prices with at least 30 days' notice by email. A price change never applies to a term you have already paid for.

8. AI features

Some features use a third-party AI model to read a product photograph or draft a description. AI output is a starting point and can be wrong: it may misread a specification, invent a detail, or describe the wrong product. You are responsible for checking anything AI produces before publishing it, and you remain responsible for the accuracy of your listings.

AI features have monthly limits by plan. If the AI is unavailable, features that depend on it return an empty result rather than an error, so the rest of the app keeps working.

9. Deleting things

When you delete a catalog or a product it goes to a bin. It stops being visible to anyone immediately — including anyone holding a link you had shared — and you can restore it from the bin for 7 days. After 7 days it is permanently destroyed and cannot be recovered by us or by you. You may also choose to delete permanently straight away, in which case there is no bin stage and no recovery.

Deleting a catalog also deletes its products, its quotes and invoices, its discount codes, its invite list and its view statistics.

To close your account entirely, contact us at pechenergysolutions@gmail.com. We will delete your account data within 30 days, except records we must keep for tax or accounting purposes.

10. Availability

We work to keep Lumina Catalog available but do not promise uninterrupted service. We may take it down for maintenance, and features may change, be added or be withdrawn. If we withdraw a feature that is central to a plan you are paying for, you may cancel and receive a pro-rata refund of the unused part of your term.

11. Limits on our liability

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Subject to that: we are not liable for lost profits, lost sales, lost goodwill or lost data arising from your use of the service, and our total liability to you in any 12-month period is limited to the amount you paid us for the service in that period. If you are on the free plan, that amount is nil, and your remedy is to stop using the service.

12. Ending the agreement

You may stop using Lumina Catalog at any time. We may end this agreement by giving you 30 days' notice, or immediately if you materially breach section 3. If we end it without cause while you are on a paid term, we will refund the unused part of that term.

13. Changes to these terms

We may update these terms. If a change materially affects your rights we will give at least 30 days' notice by email or in the app before it takes effect. Continuing to use the service after that means you accept the change.

14. Governing law

These terms are governed by the laws of Nigeria, and the courts of Lagos State, Nigeria have jurisdiction over any dispute. Nothing in this section removes a consumer protection right you have under the Federal Competition and Consumer Protection Act 2018 or other law that applies to you regardless of agreement.
